　　7 Equitable remedies
　　Equitable remedies are discretionary. They cannot be claimed where:
　　(i) Delay defeats equity (doctrine of laches)
　　(ii) The contract has been affirmed
　　(iii) The injured party has not acted fairly
 
　　8 Specific performance
　　8.1 (a) Equitable remedy.
　　(b) This is a decree to enforce a contract and make parties complete their obligations under it.
　　(c) The court will not make such an order where:
　　(i) damages are an adequate remedy
　　(ii) the contract is for personal services
　　(iii) the court cannot adequately oversee the order if granted
　　(iv) it will be unfair (because this is an equitable remedy).
 
　　9 Injunction
　　9.1 An injunction is a negative stipulation normally granted to prevent a person breaching a contract: Warner Bros v Nelson. It will not be used to enforce positive obligations.
 
　　10 Rescission
　　10.1 This entitles the injured party to treat the contract as at an end. The parties will be restored to the position they were in before the contract was made. Hence property transferred can be recovered.
　　This applies if the contract is voidable. A party must be satisfied that the right has arisen or that party will be in breach of contract.
